(USSA) Motorcycle Pollution

Yesterday, Arizona became the first state to try to opt out of the new air pollution regulations for motorcycles that are scheduled to take effect in 2010.

The new set of laws would have mandated emissions testing for bikes registered in the Phoenix metropolitan area. In a written petition to the Environmental Protection Agency (EPA), the Arizona Department of Environmental Quality argued that only 3.5 percent of the vehicles registered in Phoenix are motorcycles; that emissions failure rates for bikes are down; and that repairs to improve motorcycle emissions do not substantially improve air quality.

Smog Checks

Fifteen states now require emissions inspections for cars and trucks in one or more municipal areas. The states are: Alaska, Arizona, California, Colorado, Connecticut, Georgia, Illinois, Indiana, New Mexico, Nevada, Ohio, Oregon, Tennessee, Washington and Wisconsin. Arizona would have been the first state to mandate motorcycle emissions inspections.

Last February, a California State Senator named Fran Pavley introduced Senate Bill 435 which would have mandated smog checks for motorcycles. The bill was dead by July. But, the fact that such a bill was introduced at all is a bad omen for bikers.

(USSA) Mongols Patch Fight Continues

Old news folks, but extremely pertinent for all!

Obviously, the government wants a rematch in the fight for the Mongols trademarks. Preferably, sometime after Judge Florence-Marie Cooper retires next spring.

Last Monday federal prosecutors filed a motion in the Ramon Rivera v. Ronnie Carter etc. et al. civil case asking Judge Cooper to dismiss the Rivera suit. The motion asks for a hearing on December 14th. The government argues that Rivera’s suit should be dismissed on grounds that it is moot - which is to say that there is no longer an actual legal controversy between the government and unindicted members of the Mongols Motorcycle Club over whether they may or may not wear the club’s patch and top rocker.

Throughout the 13 months of this case, the government has sought to criminalize membership in the motorcycle club: To in effect secure an unconstitutional Writ of Attainder against the Mongols Motorcycle Club. The government’s original strategy was to seize the name Mongols and the Mongols logo. As part of his plea deal, former Mongols President Ruben “Doc” Cavazos claimed he owned the Mongols trademarks and then gave them to the government.

(USSA) Eighth defendant pleads in Pagans case

CHARLESTON, W.Va. -- An Ohio construction worker admitted in federal court Thursday that he helped members of the Pagans Motorcycle Club shut down a support club for being disloyal.

Steve Harlan "Creature" Stover, 50, of Proctorville, pleaded guilty to one count of conspiring to commit and assault with a dangerous weapon in aid of racketeering.

Stover, one of 55 defendants named in an indictment unsealed last month, is the eighth defendant to strike a plea deal with federal prosecutors. The sweeping, 44-count indictment accuses Pagans members and associates of using violence and intimidation to control territory from New Jersey to Florida.

In November 2004, Stover was a member of the Last Rebels Motorcycle Club, which was affiliated with the Pagans, according to a stipulation of facts entered as part of his guilty plea. Last Rebels wore a "16" patch on their colors, or sleeveless jean jackets, which referred to P being the 16th letter of the alphabet, and symbolized their loyalty to the Pagans.

Under orders from the Pagans, Stover and other Last Rebels traveled with Pagans to the clubhouse of the Road Disciples Motorcycle Club in Portsmouth, Ohio, the stipulation states.

(CAN) Key Bandido murder figure Kellestine files notice of appeal over Nazi flag

TORONTO — Wayne Kellestine intends to appeal his convictions for eight counts of first-degree murder in the Bandido murder case.

And, in his inmate notice of appeal, he says Nazi paraphernalia he owned shouldn't have been used against him. Kellestine was convicted, along with five other men, in the April 2006 deaths of eight men linked to the Toronto Bandidos biker gang.

The trial was told Kellestine, a Toronto Bandido, led Bandidos from Winnipeg in slaughtering the eight men at his southwestern Ontario farmhouse.

Kellestine says he wants to appeal his convictions and sentence, while the five other men previously filed notices too.

In the notice filed with the Ontario's Appeal Court, Kellestine writes that the judge erred in allowing "the German swastika flag," seen hanging at his property, to be evidence against his character.

He also alleges the judge erred in "refusing to give a warning on the dangers" of co-accused Michael Sandham's evidence.

Sandham, a former police officer, testified to his version of events of the night of the murders, which placed the lion's share of the blame on Kellestine.

Sandham admitted on the stand that he had previously lied to police when he told them over and over again that he wasn't at Kellestine's the night of the murders.

http://

Alex Caine, before he became a best-selling author, used to wake up every morning and dress himself in lies. And then he would venture out into a day that, every day, had a better-than-average chance of being his last. Caine used to be what is known as a contracted agent. A professional infiltrator. An inside man. Not the line of work most would choose if they actually expected to, one day, enjoy their RRSPs. To hear him tell it, he didn't have much in the way of choice.

Though a Canadian originally from Hull, Quebec, Alex Caine (almost certainly not his real name) served with U.S. Forces in Vietnam. His experience there would prove to be the start of a 30-year journey as a contracted agent. "I was in the Marine Corps," Caine told me at a downtown Montreal coffee shop last week, "and when I got out I was kind of messed up and ended up coming back to Vancouver and getting into a bit of trouble, because it was 1971... everybody was getting in trouble. So I ended up going to jail."

Caine found himself in a federal penitentiary serving 20 months for marijuana possession. "But I did well in jail because it's a male, macho environment. And because I had just come out of the service, I fit in like a glove." Upon his release, Caine was approached by former fellow inmates with Asian gang connections to help them develop heroin distribution centres eastward, into Quebec, where Caine's facility with French, as well as his loyalty while incarcerated, made him a valuable asset.

Conn. officer charged in fatal crash drove 94 mph

The Associated Press
November 18, 2009, 4:03 PM

An arrest affidavit says a Milford police officer charged with manslaughter for a car crash that killed two teenagers was driving 94 miles per hour and was not on an emergency call. State police earlier this month charged Jason Anderson with two counts of second-degree manslaughter and one count of reckless driving. He was released on $250,000 bond.

Police said 19-year-old David Servin and 19-year-old Ashlie Krakowski were killed in the June 13 crash.

Police released a videotape of the crash Tuesday that shows the car carrying the teens turning into the path of Anderson's cruiser, which slams into the car and sends debris flying. The New Haven Register and Connecticut Post requested the video.

A telephone message was left Wednesday with Anderson's attorney, Hugh Keefe.

http://

The Southern Brother’s Motorcycle Club in Bath County is giving back to the children of those behind bars. The motorcycle club on Stepstone Road in Bath County is partnering with Strike Force prison ministries to provide gifts this Christmas for those that may not get any.

“My ministry and the three other prison ministries get together and give away 10,000 Christmas stockings every year to the children of prisoners in every state prison throughout the whole state of Kentucky and that’s a big undertaking,” Hanshaw said. “That’s easily $7 a stocking and $70,000 a year and that’s all given.”

The Southern Brothers motorcycle club has worked with Strike Force prison ministry since 2005.

“Since we’ve been around we’ve always done charity work,” Southern Brothers Motorcycle founding member “Six-pack” said. “It’s always been our main goal. We’ve had people in jail and prison, not that we’re bad people but sometimes you end up that way. We know what Hanshaw was doing was a good thing, he was sincere and we knew whatever we did, it would be dealt with the right way.

“It doesn’t matter if you’re Southern Brothers, bikers get a bad image,” Six Pack said. “We don’t sell drugs or gun run like you see on television. We get out and ride, we enjoy riding and partying together.”

“We’ve always been charitable and we’ve always tried to show a good face in the community,” ‘Big Daddy’ said. “Everybody’s welcome here, we don’t turn people away. We try to do good for the people and we try to show people that we’re good people. We don’t bother people and we don’t want to be bothered in that way. We take care of our brothers and ourselves. If I’ve got a loaf of bread my brother knows he’s got half of it.”

The members of Southern Brothers motorcycle club presented Hanshaw with a check to help purchase the stockings in October.

http://
