(CAN) Full-patch Hells Angel gets day parole

Ronaldo Lising granted six-month trial period despite maintaining ties to notorious gxxg

Full-patch Hells Angel Ronaldo Lising has been granted day parole, despite concerns from parole board members about his ongoing membership in the notorious biker gxxg.

Lising, 49, had been serving an 11-year, nine-month sentence for a series of convictions including conspiracy to traffic, gun possession and assault.

He had been denied earlier bids for both full parole and day parole because of negative associations and bad behaviour in jail.

But on May 3, Lising was granted a six-month day parole trial after improving his conduct on the inside and taking courses to better his chances of rehabilitation, according to parole board documents obtained by The Vancouver Sun. Lising's life was under threat in prison last year, the documents said, and he was put in segregation for his own safety.

After he was sent back to the general population, he was found unresponsive in his cell on April 16, 2011 with a large amount of methadone in his system.

There was no explanation in the documents about how he ingested the drug beyond a comment that: "The Security Intelligence Officer investigated the incident to determine if there was a link which resulted in your being segregated for your safety."

At Lising's hearing this month, some Corrections officials expressed concern that he had not yet left his position with the elite Nomads chapter of the Hells Angels.
"When asked why you had not yet resigned from this organization, you said this particular Hells Angels motorcycle club required the resignation to be done in person with a formal handing over of colours and other Hells Angels paraphernalia and could not be done by sending a letter from prison," the parole board members noted.

Lising told them he would "resign from the Hells Angels as soon as [he] could do so in a manner acceptable to the club." Lising was grilled by board members about the biker gxxg and its links to organized crime. "You basically described this club as a group of men who like to ride motorcycles together," the parole board said.

"When asked, you estimated that the Hells Angels have a majority of its members not engaged in crime, but a significant minority of its members are engaged in crime."

Lising told the board that "club business" was not criminal and that drug trafficking and other crimes were the "personal business" of members.

The board said Lising was minimizing the activities of the Hells Angels and that "it's clear to the board that your continued membership and/or association to this motorcycle club would expose you to individual members of the club engaged in crime."

Some of Lising's convictions stem from the special under-cover probe dubbed E-Pandora that used agent Michael Plante to infiltrate the Hells Angels.

When Lising's house was raided in July 2005, police found "handguns, ammunition, a pen gun capable of single-shot fire, body armour, brass knuckles and what was described as an abduction kit, which contained a balaclava, gloves, walkie talkies and plastic zap straps," the parole documents noted.

Board members Ulf Konrad Ottho and Laura Hall imposed special conditions on Lis-ing's release into a community facility.

He can't associate with any Hells Angels or hang-arounds and prospects in their program. He can't wear his Hells Angels colours or other items with the gxxg insignia or indicating sup-port for the organization. And he can't attend clubhouses or Hells Angels events.

"The special conditions are considered reasonable and necessary to protect society and assist in your reintegration as a law-abiding citizen," they said.

http://www.vancouversun.com/news/Full+patch+Hells+Angel+gets+parole/6628926/story.html

(USSA) Mongols motorcycle gxxg member sentenced for murdering rival Hells Angels member

SAN FRANCISCO -- A member of the Mongols motorcycle gxxg was sentenced in federal court in San Francisco on Tuesday to life in prison without parole for murdering a member of the rival Hells Angels motorcycle club in the city in 2008.

Christopher Ablett, 39, of Modesto, was found guilty in February of murdering Mark "Papa" Guardado, president of the San Francisco Hells Angels chapter, by shooting and stabbing him during a fight outside a bar in the Mission District of the city on Sept. 2, 2008.

A jury in the court of U.S. District Judge Richard Seeborg convicted Ablett of four federal charges: murder in aid of racketeering, assault with a deadly weapon, using a gun in a violent crime and using a gun in a murder.

U.S. Attorney Melinda Haag said testimony at the trial indicated that Ablett, armed with a revolver and a 12-inch military knife, came to San Francisco to visit a friend.

Haag said that when Guardado heard that Ablett was in the bar, he came to the street outside the bar and approached Ablett, according to witnesses at the trial.

A fight then broke out and Ablett stabbed Guardado four times and shot him twice, Haag said.

Ablett was sentenced today by Seeborg, who ordered him to serve two concurrent life terms plus one consecutive life term. There is no parole from federal life sentences, according to Haag.

Haag said in a statement, "The defendant killed a complete stranger for no reason other than his membership in a rival motorcycle gxxg.

"This sentence should send a clear message that there is a heavy price to pay for engaging in such a senseless act of violence," she said.

http://www.mercurynews.com/breaking-news/ci_20632136/mongols-motorcycle-gang-member-sentenced-murdering-rival-hells

(AUS) Anti-bikie laws a legal headache

ANTI-bikie laws could be plagued by costly and embarrassing legal challenges, Victoria's peak law body says.

The Baillieu Government must get the legislation right because the laws would almost certainly be challenged by outlaw motorcycle clubs, Law Institute of Victoria president Michael Holcroft said.

But the State Government, which wants its laws enacted this year, says the LIV will be proved wrong.

The Department of Justice has been working on the legislation since the Coalition won government in 2010.

In the same year outlaw gxxg the Finks won a High Court ruling against South Australian anti-bikie laws, and Hells Angels won a ruling against similar laws in NSW last year.

The Government says the law institute has not seen draft legislation, which would be drawn up to avoid successful High Court challenges.

Briefings are being held with Victoria Police and others.

Mr Holcroft said that proscribing gxxgs as criminal entities had been difficult and expensive.
"Effectively you will have to prove they are criminal organisations,'' he said.

"The Baillieu legislation is trying to create guilt by association.

"It's very difficult. I don't know whether it's worth the effort.''

He said the Crimes Act (1958) allowed authorities to seize assets and profits of crime.

The Government's plan to rip down fortifications was likely to fail, he said.

"Every business owner and most clubs take steps to secure their assets,'' he said.

"The first proscribed bikie entity will be off to the High Court.
Former top FBI agent charged with child porn distribution

(CNN) -- A former supervisory FBI agent has been arrested and jailed on child pornography charges.

Donald Sachtleben was taken into custody and charged Monday after a nationwide undercover investigation of illegal child porn images traded over the Internet.

The 54-year-old resident of Carmel, Indiana, has pleaded not guilty and has a detention hearing in federal court Wednesday.

A federal complaint alleges 30 graphic images and video were found on Sachtleben's laptop computer late last week when FBI agents searched his home, about 23 miles north of Indianapolis.

The arrest was a result a months-long probe, said the U.S. attorney for the Southern District of Indiana, Joseph Hogsett.

"The mission of our Project Safe Childhood initiative is to investigate and prosecute anyone found to (be) engaged in the sexual exploitation of children," Hogsett said in a news release. "No matter who you are, you will be brought to justice if you are found guilty of such criminal behavior."

Sachtleben is currently an Oklahoma State University visiting professor, according to his online resume. He is director of training at the school's Center for Improvised Explosives, but all references to his work have now been removed from the university's website. There was no indication from the school as to whether it had suspended him. Calls to the university and his Indianapolis attorneys were not immediately returned.
He had been an FBI special agent from 1983 to 2008, serving as a bomb technician. He worked on the Oklahoma City bombing and Unabomber investigations, according to his university biography.

A separate LinkedIn profile filled out by Sachtleben says he is an "accomplished investigator with more than 25 years of experience in FBI major case management, counter terrorism investigations, bombing prevention, post blast investigations and public speaking."

According to the criminal complaint, a federal-state joint task force had been investigating an Illinois man allegedly trading child porn images as far back as September 2010. That suspect was arrested in January, and a search of his computer reportedly led to Sachtleben, who was using the e-mail name pedodave69.

According to the affidavit, an e-mail from that account was sent to the Illinois suspect last fall, along with nine images of child porn. "Saw your profile on (a file sharing network). Hope you like these and can send me some of ours (sic). I have even better ones if you like." Prosecutors say Sachtleben sent that e-mail.

Sachtleben's wife was interviewed by agents during the execution of the search warrant and denied any involvement with child porn. She was not taken into custody.

FBI officials in Washington had no comment on the arrest.

If convicted, Sachtleben would face up to 20 years in prison on the charge of distribution of child porn, and an additional 10 years for possession.

The Justice Department's Project Safe Childhood initiative was launched in 2006, leading to what federal officials call a more than 40% increase in the number of cases investigated. The project's website says 2,700 indictments were filed last year alone.

The case is U.S. v. Sachtleben (1:12-mj-316).

http://www.cnn.com/2012/05/15/justice/ex-fbi-agent-pornography/index.html
[Submitted by HellGato]
